The agreement between you and Twizzle LLC governing use of our platform
By accessing or using the Twizzle platform (the "Services") provided by Twizzle LLC ("Twizzle," "we," "us," or "our") at https://twizzle.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services. These Terms constitute a legally binding agreement between you and Twizzle LLC.
You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
To access certain features of the Services, you must create an Account by providing accurate, current, and complete information. You may register using an email address and password or through a third-party authentication provider. You agree to update your Account information promptly if it changes.
You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree to notify us immediately of any unauthorized use of your Account. Twizzle is not liable for any loss or damage arising from your failure to maintain the security of your Account.
Twizzle offers subscription-based access to the Services with the following plan options:
Plan features, pricing, and availability are subject to change. Current plan details are available on the Platform.
All payments are processed by Stripe. By subscribing to a paid plan, you authorize Twizzle to charge your payment method through Stripe for the applicable subscription fees. All fees are stated in U.S. dollars and are exclusive of applicable taxes unless otherwise stated. You are responsible for providing a valid payment method and ensuring sufficient funds are available.
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged the then-current rate for your plan at the time of renewal. We will notify you of any price changes before they take effect.
If a payment fails, we may retry the charge according to our payment processor's retry schedule. If payment cannot be collected after multiple attempts, your Account may be downgraded or suspended. We may notify you of failed payments and provide an opportunity to update your payment method before suspension.
You may cancel your subscription at any time before the next billing date through the Platform's account settings or by contacting us at support@twizzle.io. Upon cancellation, your subscription remains active until the end of the current billing period. After the billing period ends, your Account will be downgraded and you will lose access to paid features.
Refunds are handled in accordance with our Refund & Cancellation Policy. Generally, subscription fees are non-refundable except as required by applicable law or as otherwise described in our Refund Policy. Please review our Refund Policy for full details on eligibility and the refund process.
You are responsible for your use of the Services and any Content you create, upload, schedule, or publish through the Platform. You agree to use the Services in compliance with all applicable laws and regulations and in accordance with these Terms.
You agree to use the Services only for lawful purposes and in a manner consistent with these Terms. You must comply with all applicable laws, the terms of service of any Connected Accounts, and the community guidelines of any social media platforms you use through the Services.

You retain ownership of all Content you create and upload to the Services. By uploading Content, you grant Twizzle a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and distribute your Content solely as necessary to provide the Services. This license terminates when you delete your Content or Account, except for copies that may exist in our backups for a limited period.
You represent and warrant that you have all necessary rights to the Content you upload and that your Content does not violate any third-party rights or applicable laws.
The Services allow you to connect third-party social media accounts (Connected Accounts) to schedule, publish, and manage content. By connecting a social media account, you authorize Twizzle to access your account data through the platform's APIs as described in our Privacy Policy. You are responsible for complying with the terms of service of each Connected Account.
The Services include AI-powered features that use third-party AI API providers to generate content suggestions, captions, hashtags, and other text. AI-generated content is provided as a suggestion only. You are solely responsible for reviewing, editing, and approving all AI-generated content before use or publication.
Twizzle does not guarantee the accuracy, quality, originality, or appropriateness of AI-generated content. You should not rely on AI-generated content without independent review. We are not liable for any claims, damages, or losses arising from your use of AI-generated content.
The Services, including all software, designs, text, graphics, logos, icons, and other materials, are the property of Twizzle LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Services or our intellectual property except as expressly stated.
Subject to your compliance with these Terms, Twizzle grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business or personal purposes during your subscription period.
The Services may include gamification features such as creator challenges, experience points (XP), badges, and leaderboards. These features are provided for engagement and community purposes. Twizzle reserves the right to modify, suspend, or discontinue any gamification features at any time. XP, badges, and leaderboard rankings have no monetary value and cannot be exchanged, transferred, or redeemed outside the Platform.
We may offer beta or early-access features that are still in development. Beta features are provided "as is" without any warranties. We may modify or discontinue beta features at any time without notice. Your use of beta features is at your own risk and may be subject to additional terms.
If we provide API access, your use of the API is subject to these Terms and any additional API-specific terms. You agree not to exceed any rate limits, misuse API endpoints, or use the API in a manner that could damage or impair the Services.
We strive to maintain high availability of the Services, but we do not guarantee uninterrupted or error-free operation. The Services are provided on an "as available" basis. We are not liable for any downtime, interruptions, or performance issues.
We may perform scheduled or unscheduled maintenance that may temporarily interrupt the Services. We will make reasonable efforts to provide advance notice of scheduled maintenance. We are not liable for any loss or damage resulting from maintenance-related interruptions.
The Services may integrate with or contain links to third-party services, websites, or applications. Twizzle is not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is at your own risk and subject to the terms and policies of those services.
Your use of the Services is subject to our Privacy Policy, which describes how we collect, use, and protect your Personal Information. By using the Services, you consent to the data practices described in our Privacy Policy.
If you provide suggestions, ideas, feedback, or recommendations regarding the Services ("Feedback"), you grant Twizzle a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such Feedback into the Services without any obligation to you.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TWIZZLE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TWIZZLE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
IN NO EVENT SHALL TWIZZLE'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE TOTAL AMOUNTS PAID BY YOU TO TWIZZLE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Twizzle LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your Content, your violation of these Terms, or your violation of any rights of a third party.
Twizzle may suspend or terminate your Account and access to the Services at any time, with or without cause, including for violations of these Terms. Upon termination, your right to use the Services ceases immediately. We may, but are not obligated to, provide you with notice before suspension or termination. Sections of these Terms that by their nature should survive termination will survive.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration, rather than in court, except that either party may seek injunctive or equitable relief in court for intellectual property matters.
Class Action Waiver: You agree that any arbitration or proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in class actions, class arbitrations, or representative proceedings.
Arbitration Rules: Arbitration shall be administered under the rules of the American Arbitration Association (AAA) or a mutually agreed-upon alternative. The arbitrator's decision shall be final and binding.
Twizzle shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, power failures, internet outages, or third-party service failures.
You agree to comply with all applicable export and re-export control laws and regulations, including U.S. export controls. You may not access or use the Services in any country or region subject to comprehensive U.S. sanctions or if you are on any U.S. government restricted party list.
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and may notify you via email or through the Platform. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Services.
